1. Acceptance of Terms

By accessing tomasyano.com (the "Site") or subscribing to the newsletter (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Services.

2. Description of Services

The Services include:

  • Access to articles and content published on the Site
  • A free email newsletter delivered to subscribers
  • Optional one-on-one consultation calls (when booked separately via cal.com)
  • Paid offerings such as consultation sessions, courses, memberships, or digital products (when available)
  • Educational content related to intuition, body intelligence, and personal development

All content is provided for informational and educational purposes only. Nothing on the Services constitutes medical, psychological, legal, financial, or other professional advice.

2a. Payments

Paid services are processed through Stripe Payments Europe Ltd. ("Stripe"), our third-party payment processor. By making a payment, you also agree to Stripe's Terms of Service (stripe.com/legal) and Privacy Policy (stripe.com/en-pl/privacy).

  • Prices: Displayed in EUR or USD as indicated at checkout. Prices include applicable VAT where required.
  • Card data: Collected directly by Stripe. We never see, store, or transmit your full card details.
  • Refunds: Refund policy for each paid offering is specified at the point of purchase. For consultation calls, refund is available if cancellation occurs at least 24 hours before the scheduled time.
  • Consumer rights: EU consumers have a 14-day right of withdrawal for digital services, except where the service has been fully performed with your prior express consent (e.g., a completed consultation call).
  • Failed payments: If a payment fails, access to paid content may be suspended until the payment is resolved.

3. Eligibility

You must be at least 16 years old to use the Services. By using the Services, you represent that you meet this requirement.

4. Newsletter Subscription

By subscribing to the newsletter:

  • You consent to receive emails from us at the address you provide
  • You may unsubscribe at any time using the link in any newsletter email
  • We will use your email address as described in our Privacy Policy

You agree to provide accurate information when subscribing. Subscribing with someone else's email address without their consent is prohibited.

5. Intellectual Property

All content on the Services, including articles, newsletter content, frameworks, methodologies, graphics, logos, and trademarks, is the intellectual property of Tomas Yano or used with permission, and is protected by copyright and other intellectual property laws.

Permitted use:

  • Personal, non-commercial reading and reference
  • Sharing links to public articles on social media
  • Quoting short excerpts with attribution and a link back to the source

Prohibited use:

  • Reproducing or republishing substantial portions of content without written permission
  • Commercial use of any kind without a license
  • Training AI models on our content without written permission
  • Removing copyright notices or attributions

6. User Conduct

When using the Services, you agree not to:

  • Violate any applicable law or regulation
  • Impersonate any person or entity
  • Harass, threaten, or abuse the operator or other users
  • Attempt to gain unauthorized access to the Site, accounts, or systems
  • Interfere with the operation of the Services (e.g., spam, scraping, denial-of-service attempts)
  • Use the Services in any way that could damage, disable, or impair them

The Services may contain links to third-party websites (e.g., cal.com, X, Telegram, external research). We are not responsible for the content, privacy practices, or terms of any third-party sites. Use of third-party services is at your own risk and governed by their respective terms.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Content shared through the Services represents the personal views, experiences, and research of Tomas Yano. It is not professional advice. You are responsible for evaluating the information and consulting qualified professionals (medical, mental health, legal, financial) before acting on anything you read.

We do not guarantee that:

  • The Services will be uninterrupted, error-free, or secure
  • Information on the Services is accurate, complete, or up to date
  • The Services will meet your specific needs or produce specific results

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TOMAS YANO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or, if you have not paid anything, EUR 50.

Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in such jurisdictions, our liability is limited to the extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Tomas Yano from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Services.

11. Termination

You may stop using the Services at any time by unsubscribing from the newsletter and ceasing to access the Site.

We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Any disputes arising from or related to these Terms or the Services shall be resolved in the competent courts of Poland.

If you are a consumer residing in the EU, you may have rights under EU consumer protection law that apply regardless of this clause.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to active subscribers and posted on this page with an updated "Last Updated" date. Continued use of the Services after changes constitutes acceptance.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
